Updated October 22, 2026: The Trump administration filed an emergency application asking the U.S. Supreme Court to pause Judge Kathleen Cardone’s injunction and allow the Big Bend border-barrier project to proceed. The filing also asks the Court to take up the case and reverse the lower-court order.

The application is not a Supreme Court ruling. As of this update, the injunction remains in place; construction can resume only if the Court grants the requested relief or the order otherwise changes. The underlying challenge concerns barrier construction and related federal waivers in the Big Bend region.
