Texas Comptroller Don Huffines signed an executive order on October 6 directing the agency to propose an amendment to state tax rules covering information and data-processing services. The proposal would remove sales tax from electronic health-record and medical-record systems, patient portals, and other technology used to maintain, access or share medical records.
The change is not yet final. The comptroller said the proposed amendment will be filed with the Texas Secretary of State, published in the Texas Register and opened for 30 days of public comment. That process matters because it gives taxpayers and healthcare providers a formal opportunity to challenge or support the interpretation before implementation.
